Overview
By accepting this Privacy Policy and user agreement, you expressly consent to our use and disclosure of your personal information in the manner described in this Privacy Policy. If you object to this use and disclosure, please do not register with us.

Please note that your Information might be stored and processed on computers outside of Sweden, in countries which might have laws less stringent than the Swedish laws, such as the United States. But we will hold and transmit your information in a safe, confidential and secure environment.

 

1. PERSONAL DATA WE COLLECT
Our primary goal in collecting personal information is to provide you with a safe, efficient, and personalized experience. We only collect personal information about you that we consider necessary for this purpose.

At the time of registration on the Service, we may require you to provide contact and identity information, financial information and other personal information as indicated on the forms throughout the Site. You always have the option not to provide information by choosing not to use a particular service or feature. We have the right and the possibility to verify the stated information. Under some circumstances we may require some additional financial information, such as, but not limited to, credit card details. Gathered personal data may also be supplemented with data from elsewhere or after we contact you and asked you for specific additional information.


Certain information may be collected when using the Site such as name of Internet service provider, IP-address and the domain you connect from or go to, information about operating system, web browser and date and time for login and activity on the Site.


If you bid, buy or sell on the Site, we collect information about your bidding, buying and selling behaviors. We also collect other users' comments about you in our feedback area. If you post messages on our community boards or other message areas or leave feedback for other users, we will collect that information.


If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Site, we may collect such information into a file specific to you.

 

2. USAGE OF PERSONAL DATA
The gathered personal data is used in order to provide, administer and control an electronic meeting and marketplace and your usage thereof, as well as in order to prevent abuse of such electronic meeting and marketplace.


A Member's personal data is also used to be able to provide a more efficient support and to improve our content and product offerings, and customize the Site's content, layout, and services. Further, a Member's personal data may be used for invoicing purposes and to send important information to the Member, such as change of fees or updates of the Terms.


Other companies are sometimes engaged to provide certain services to the Member. These companies might for instance function as web hotels or act as intermediaries to send information to the Member. The companies are only granted access to such personal data needed in order to be able to fulfill their obligations for such purposes. All such companies are bound by agreements and are obliged not to use the information for other purposes.


You expressly agree that we may use your information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as targeted banner advertisements, administrative notices, product offerings, and other communications such as newsletters relevant to your use of the Site. If you do not wish to receive these communications, you always have the right to oppose to such usage by informing us in writing.

 

3. DISCLOSURE OF PERSONAL DATA
As a matter of policy, we will never sell or rent your personal information to third parties for their marketing purposes without your explicit consent. However, the following describes some of the ways that we may disclose your personal information.


a) Community. Your alias is displayed throughout the Site and is therefore available to the public. All your activities on the Site (such as bids, purchased items, feedback, postings) will be identifiable to your alias. A Member is given the possibility to contact other Members on the Service when logged in. Contact is made possible either by making e-mail addresses available to other Members in order for them to be able to receive additional information from a Seller or Bidder regarding a specific item or through a web based contact service. A Member's name, address, and telephone number ("Contact information") is not available to other Members. However, Contact Information will be disclosed to the Seller and the Buyer when a transaction is completed successfully. The Contact information is also made available on the Site for the benefit of the respective parties during a limited period of time. A Member's personal identity number and credit card number is never disclosed to another Member.


b) Other Corporate Entities. You agree that we may share your personal data with our parent, affiliates, subsidiaries and joint ventures that are committed to serving your online trading needs and related services, throughout the world. It is possible that we, our parent or subsidiaries could merge with or be acquired by another business entity. Should such a combination occur, you agree that we may share some or all of your information in order to continue to provide the service.


c) Internal Service Providers. We may use third parties that we refer to as internal service providers to facilitate or outsource one or more elements of our services (e.g. search, identity verification, surveys, affiliate and reward programs, marketing services) and therefore we may provide some of your personally identifiable information directly to them. These internal service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information for any other purpose except to facilitate the specific outsourced operation.


d) External Service Providers. There are a number of separate services offered by third parties that we refer to as external service providers that may be complimentary to your use of the Site (e.g. co-branded sites, listing agents, escrow and payment services). If you choose to use these optional services, and in the course of doing so, disclose information to the external service provider, then their use of your information is governed by their privacy policy.


e) Legal Requests. We cooperate with law enforcement inquiries, as well as other third parties, to enforce laws and third party rights, such as intellectual property rights and laws relating to fraud. This means in particular:


- We can (and you authorize us to) respond to a request by law enforcement or other government officials, relating to a criminal investigation or alleged illegal activity, or other activity that may expose us or you to legal liability, we can disclose personal information such as name, address, telephone number, email address, alias and User ID history, IP history, and bidding and listing history about you as we, in our sole discretion, believe necessary or appropriate.


- Further, we can (and you authorize us to) disclose your alias, User ID, name, address, telephone number, email address, and company name to intellectual property rights owners in connection with an investigation of fraud, intellectual property infringement or other unlawful activity.


- Finally, we can (and you authorize us to) disclose your alias, User ID, name, address, telephone number, email address, and company name to third parties if it is necessary to safeguard their interests. A disclosure is not necessary and will not take place if the third party can contact you by using the features on the Site, or initiate criminal investigations against you, or if such investigations already take place.


Transfer outside EU and EEA. All Members understand and agree that their personal data, for the legitimate purposes set out herein, may be transferred to a country outside of the EU or EEA (including, but not limited to, Switzerland and the United States of America), even if such country does not provide an adequate level of data protection in accordance with the requirements of the Personal Data Act (1998:204).


We cannot ensure that all of your communications with us and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy.

 

4. PERSONAL DATA ENQUIRY
You have the possibility to review and update your personal data yourself. This can be done when logged in on the Site. You must promptly update your personal information if it changes or is inaccurate. Generally, we will not modify your personal information based on your request because it is very difficult to authenticate your account manually. You may only update the latest information registered. We save all personal data stated by you.


Once a year and free of charge, you may upon a written request, receive a notification regarding the personal data being processed about you.

 

5. COOKIES
We use cookies on certain pages of the Site. Cookies are small text files which are stored temporarily in the computer RAM memory or stored on the hard drive when using the Service. Cookies cannot spread virus to the computer. Cookies are primarily used to make the Service easier to use for Members. The cookies will help reduce the process time for certain applications since the computer has stored information from earlier visits for future visits.


A Member may at his/her own choice permit or block cookies. Normally web browsers accept cookies automatically, but they can be blocked by changing the settings. In case a Member chooses not to accept cookies the Service may not function properly.

 

6. PROTECTION OF PERSONAL DATA
We safeguard stored personal data. In order to protect the data, organizational measures, as well as several different technical solutions and security measures are used to prevent undue access and usage thereof. We store personal data on servers located in secure premises with restricted access. However, 'perfect security' does not exist on the Internet.

 

7. DEREGISTRATION
Upon your written request, we will deactivate your account, contact information, and financial information from our active databases. Such information will be deactivated as soon as reasonably possible in accordance with our deactivation policy and applicable law. We will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our user agreement or keep our feedback system in place. Further, such prior information is never completely removed from our databases due to technical and legal constraints, including stored 'back up' systems. If you ask for deregistration, you will no longer be able to use the Service.

 

8. AMENDMENT
We may amend this Privacy Policy from time to time in order that it accurately reflects the regulatory environment and our own data collection and disclosure practices. All amended terms shall automatically be effective 30 days after they are initially posted on the Site. In addition, we will notify you by sending you an email.

 

9. CONTACT
The controller of the personal data is NEFSYS or another business entity we might merge with, are acquired by or to which we assign the user agreement. If there is a change in the data controller, we will provide you notice of such change in control and the opportunity to stop the continued use of your information (by terminating the user agreement).
